Subclasses 820 & 801

The subclass 820 (temporary) and/or 801 (permanent) partner visas are applied for to cater to individuals already in Australia.

Key Details:

  • Applicants must be in Australia when lodging their application and when the subclass 820 visa is granted.
  • The subclass 820 visa is temporary, leading to the permanent 801 visa approximately two years later or at the same time when supporting a longer , substantiated relationship application.
  • Applicants must be in a genuine, ongoing relationship with their Australian partner supported by the relevant evidence.
  • Health and character requirements must be met.

Partner Visa (apply when outside Australia)

Subclasses 309 & 100

For those outside Australia, the subclass 309 (temporary) and 100 (permanent) partner visas provide a pathway to residency or temporary with work rights.

Key Details:

  • Applicants must lodge their application from outside Australia and be overseas when the subclass 309 visa is granted.
  • The subclass 309 visa progresses to the permanent 100 visa after approximately two years or at the same time when supporting a longer , substantiated relationship application.
  • Applicants must be in a genuine and ongoing relationship.
  • Health and character requirements must be satisfied.
